Theresa May has ruled out a third Commons vote on her Brexit deal on Tuesday. She tells MPs there is not enough support in Parliament at the moment for another meaningful vote, but she continues to have discussions with MPs to see if they can be convinced to vote for the deal. In her statement to MPs, she says that the EU Council has reiterated again that there "could be no re-opening of the withdrawal agreement". The UK has an extension to 11pm on the 12th of April, she says, in the event that no deal is agreed by Parliament. And the UK has written back saying that it will accept the offer of those options. But what the UK has not done, is use a legal device to alter the exit day in the EU Withdrawal Act 2018. That exit date of 11 pm on the 29th March, i.e. next Friday is now just five days away and has not been changed. And the only way that can be changed, is if a Minister of the Crown uses a regulation to do it. Further, that regulation can only be used in response to a change in both EU law and UK law that requires that date to be changed to reflect a legal truth. Now, the EU has done its bit by the EU27 leaders voting unanimously to offer the extension. One of two boxes ticked. But now UK law would have to be changed as well. Under the Withdrawal Act 2018 that exit date can only be amended by a Minister of the Crown using 'regulations'. And regulations are a form of Statutory Instrument. If you look at the passage of a standard Statutory Instrument on the government's own flow chart, you will see that the average time it would take to get it through the process to allow it to be signed by a minister of the crown to become law is - six to seven weeks! Now, before you get your hopes up, as I understand it, where time is tight, there is a type of Statutory Instrument called a 'Made' Statutory Instrument that is already signed by a minister. In this case it is laid before parliament and becomes law. With parliament being given forty days I think to overturn it. It's all very complex and I'm not a qualified lawyer, let alone a constitutional law expert. But this would rely on the Minister of the Crown having the legal power under the Royal prerogative to make such a regulation. And there is an argument that to extend Article 50 would actually require an Act of Parliament to be passed before that Statutory Instrument could actually be made. Especially if is a lengthy extension that would require a change in UK statute law. such as legislating for EU MEP elections for example. And Revoking Article 50 would certainly need an Act of Parliament as far as I can see. MPs will go to work on Monday with four days on the clock. On that Monday they will debate taking over the parliamentary timetable starting on Wednesday. On Tuesday, with three days to go, they will be holding indicative votes under government control. On Wednesday, with two days to go, they will then potentially be holding indicative votes under MPs own control. I think that will be a bit of a bunfight. That then leaves Thursday and what's left of Friday to sort out an extension for some reason that they probably won't be able to agree on - other than the Remainers amongst them needing every second they can get to reverse Brexit. And if they haven't agreed by now, I don't think another two weeks will do anything other than cause more division amongst them! And if Theresa May has not gone back to the House with her Withdrawal Agreement or the House throws it out again, they will only get a maximum two week extension - if a minister of the Crown does indeed bring forward a legal Statutory Instrument to make it law in the UK and keep threes whole mess on the road. And if this happened I would expect to see Brexiteer MPs making prayers for a Humble Address to Her Majesty to annul the Instrument under House of Commons Standing Orders together with Early Day Motions and other procedures to try and gum up the anti-Brexit works. Jeremy Corbyn's abuse of the Prime Minister shows what a reactionary misogynist he is." And Labour's Jess Phillips said it was "sexist" and he "should apologise". Furious MPs raised the matter with the Commons Speaker just minutes later. Patrick McLoughlin fumed: "Would it not be appropriate for him to come back in the Chamber and apologise?" Politicians shouted "disgrace!" and "shame!", and Tory CCHQ boss Brandon Lewis demanded he apologise. He said: "Looks shocking on the film, unacceptable in any environment." Deaf drummer Evelyn Glennie told the BBC she was very certain he had said what was claimed. But Jeremy Corbyn's spokesman insisted this afternoon he WOULDN'T say sorry, saying he'd not said that.

Once a Remainer always a Remainer it seems. The Chancellor, Philip Hammond, said on the Sophy Ridge programme: "I’m not sure that there’s a majority in parliament in support of second referendum, but it’s a perfectly coherent proposition." And, has a result, became the first government minister to say that the second referendumers have a case. He also said that his aim was to leave the EU and leave it with a deal, while personally ruling out the options a no deal Brexit or revoking Article 50 altogether. He's shied away from what he sees as the extremes of actually leaving or actually remaining, while hinting at the possibility of a second referendum. This is just a typical attempt to try and appeal to the middle ground. The trouble is, that as people have found out to their cost, there is no Brexit middle ground - you're either favour of in or you're in favour of out. So Hammond's basically put himself on the fence, while he watches what his fellow MPs do. But that's the same fence that Theresa May has been sat on all this time, and it hasn't been a particularly comfortable place for her thus far, has it? But while we're all Brexit Navel gazing in the UK, the Netherlands has thrown out a bit of a surprise that will give the Eurocrats another headache. The three year old populist anti-EU Forum for Democracy (FvD), which wants a Dutch exit, or Nexit, from the EU, will take up twelve seats in the Dutch parliament upper house in May. The Prime Minister of the Netherlands, Mark Rutte, will therefore no longer have a majority in the Senate. In his victory speech, the leader of the FvD, Thierry Baudet, said: "Arrogance and stupidity have been punished. We are being ruined by the people who should be protecting us. "We are being undermined by universities and journalists, by the people who design our buildings. "Successive Rutte governments have left our borders wide open, letting in hundreds of thousands of people with cultures completely different to ours." But the Brussels headaches don't end there. Writing in the Guardian, Larry Elliott points out that as he puts it, "the next recession will expose the eurozone as a half-baked project in need of leadership". In his article he says that while we've all been engrossed in the minutiae of Brexit, the problems with the eurozone economic model have gone largely unnoticed in the UK. And he says that the idea of the eurozone was that it would generate faster growth, but that hasn't happened he says. And he goes on to say: "The performance of the eurozone countries has got worse not better, but so much political capital has been invested in the monetary union project that there is an unwillingness to accept as much." And he also illustrates this with the telling observation that: "In Europe’s golden age, Volkswagen was a rival to Ford, and Siemens could go toe to toe with General Electric. But there is no European Google, Facebook or Amazon and in the emerging technologies of the fourth Industrial Revolution, such as artificial intelligence, Europe is nowhere." This will not be news to Brexiteers. but food for thought for Remainers maybe? And finally, still no news from the Chequers meeting yet, which we're being told is a nice and fluffy support meeting and there are no nasty plans to oust Theresa May as the Prime Minister. Yeah! By this afternoon those ministers were offering her public support.
